Drafting A Contract For A House Exchange

House swapping can be done among relatives and close friends. But increasingly, it is now done between persons that would otherwise be complete strangers. A lot of trust is need if you are to let a stranger spend their vacation at your home and especially since you might not be around to monitor them. To avoid the unnecessary hassles of going to court due to theft or vandalism, all house swappers must have a legally enforceable written agreement between them.

But how do you draft a house exchange contract? First, have a conversation with the prospective person and get to know them at a more personal level whether that is on phone or face-to-face. If the conversation you have raises some concerns about the other party, do not carry out the swap. In this case, it is better that you go with your gut than risk something only to regret it later.

Next, factor in the dates and times of arrival and departure. Are your times and that of the other party synchronised such that no one is inconvenienced when they arrive? Make it clear what items form part of the deal. For instance, will they have access to your car? If your car will not be part of the equation, they must be made aware in advance so they can make alternative transport arrangements as necessary.

Make certain that the other party is aware of any limits as to what they can engage in on your property and who is to cater for the costs of repair.
